Read all terms and conditions before accepting this request. These obligations apply if Weber County approves and releases the requested equipment. Terms version: 2026-08-17-r3.
- Fees and approval. In most cases, there is no charge for use of this equipment if approved by Weber County Homeland Security and Emergency Management. There may be cases where there is a cost for the asset and the personnel complement required to move it, based on FEMA rates. Please ask whether a fee will apply to this request. Approval is based on need and intended use. Weber County Homeland Security and Emergency Management and Weber County reserve the right to deny any application without reason or cause.
- Release inspection and custody. Once equipment is delivered or available for pick-up, a walk-around and interior inspection of the requested asset is required in the presence of a Logistics Team member or Emergency Management personnel. The inspection will follow the Inspection Checklist and the Weber County Emergency Management Equipment Loan and Chain of Custody Form presented at delivery or pick-up. Pick-up by the requesting agency requires special arrangements and is not generally approved. The Receiving Agency accepts custody of the requested equipment and assumes full responsibility and liability for the asset from release until it is picked up or returned and inspected.
- Return and inspection. Equipment must be returned on or before the anticipated return date in the same condition as released, normal wear and tear excepted. Missing equipment and damage to the exterior or interior of an asset will be charged to the requesting agency. The Weber County Shops Department will obtain a repair quote for the requesting agency to review. Outside repair facilities will not be considered, and repair facilities are selected at Weber County’s discretion. A joint inspection will be completed at pick-up or return, and new damage will be documented in Section 7 of the Equipment Loan and Chain of Custody Form.
- Overnight security. If equipment is kept overnight, it must remain in a secure location while in the Receiving Agency’s custody. When not in active use, it must be stored in a locked building, fenced or locked yard, or another secured and monitored area that prevents theft, vandalism, and unauthorized use.
- Authorized use and operators. Equipment may be used only for the purpose stated in this request and operated only by trained, authorized Receiving Agency personnel in accordance with the manufacturer’s operating instructions. Only Weber County Logistics Teams may move or transport the Mobile Command Post and the CSI Unit.
- Maintenance and fueling. Except for the Mobile Command Post and the CSI Unit, the Receiving Agency must perform routine daily checks appropriate to the equipment, including fluids, tires, cables, lamps, and batteries. Equipment must be returned clean and, when applicable, fueled to at least the level documented at release unless otherwise agreed in writing.
- No alteration or transfer. Equipment may not be modified or altered. Custody may not be transferred, sub-loaned, or assigned to a third party without prior written approval from Weber County Emergency Management.
- Access. The applicant agrees to permit law enforcement personnel, Weber County Logistics Teams, and Emergency Management personnel free and unrestricted access to and upon the premises during the event for lawful and proper purposes consistent with the request or when misuse is suspected.
- Recall. Weber County Emergency Management may recall equipment at any time, including before the anticipated return date, when it is needed for emergency operations or other county purposes. The Receiving Agency must make the equipment available promptly upon notice.
- Insurance and risk coverage. The Receiving Agency certifies that it maintains insurance or self-funded risk coverage adequate to cover loss of or damage to the loaned equipment while it is in the agency’s custody.
Liability Terms and Conditions
By accepting these liability terms and conditions, the Receiving Agency accepts custody of the requested equipment when it is released and assumes full responsibility and liability for the equipment until it is returned or picked up and the joint return inspection is completed. This responsibility includes authorized transportation, operation, security, care, loss, theft, misuse, missing items, and damage beyond normal wear and tear. The Receiving Agency agrees to pay charges assessed under Term 3, certifies that it maintains the insurance or self-funded risk coverage required by Term 10, and confirms that the person signing this request is authorized to accept these obligations on the agency’s behalf, to the fullest extent permitted by law.
